Accommodation suppliers urged to end demanding deposit from NSFAS funded university students



The National Student Financial Aid Scheme (NSFAS) has urged landlords not to require a deposit or top-up payment from NSFAS-funded students.

This arrives following NSFAS obtained reports about some accommodation vendors who require NSFAS-funded students to pay for a deposit or top-up payment so as to get entry to the permitted private accommodation.

"NSFAS reminds accommodation suppliers on the obligatory conditions, as provided by the Standardised Fixed-Term Lease Arrangement involving the non-public accommodation providers and NSFAS funded students," NSFAS stated in a statement on Thursday.

The Standardised Fixed-Term Lease Agreement states that the rent will probably be paid out every month into the accommodation supplier (lessor) by NSFAS, on behalf in the lessee (NSFAS funded student), in accordance with the NSFAS terms and conditions for private accommodation vendors’ participation on the student accommodation portal.

"The lessor may not demand or permit the lessee to pay for a deposit, top-up payments, or some other kinds of payment towards the lessor, or almost every other person in reference to this agreement, such as payment of hire, although awaiting payment from NSFAS. The lessor shall haven't any recourse towards the lessee for any default during the payment of rent by NSFAS," the agreement reads.

The NSFAS conditions and terms for private accommodation companies’ participation on the student accommodation portal also states that: "Where the NSFAS-funded student is defunded due to an incorrect choice click here by NSFAS, the student will not be answerable for payment of any arrear rent click here to your accommodation supplier, up until eventually the date of being defunded."

The scheme emphasised that any dispute arising between the parties regarding the interpretation or implementation of the agreement, must be dealt with in accordance with any dispute resolution procedure determined by NSFAS for this purpose.
